    alcardav:

Yesterdays ( October 14th ) Happenings At The Supreme Court For Ben Freeman.

It Seems The Complainant Had A  " Grilling " From Freeman's Defense Council For Three Hours, She ( Ben's Q.C.) Ripped Into The Complainant's Police Statement & It Seems To Have A Lot Of Conflicting Items & " I Can't Remembers " During The Cross Examination. It Is Also Alleged That The Complainant Got A " Good Hiding" From Her Step-mother When She Found Out The Girl Had Sex With Freeman ?

It Will Be Interesting To See If Ben Takes The Stand In His Own Defense But Then He May Not Need Too.

It Is Now The Turn Of The Accused, Ben Has Taken The Stand In His Defense, & The Crown Prosecution Has First Go At Him, It Seems To Have Been Very Emotional & Ben Is Still Going With The " Consent "  Belief. He Seems To Be Holding Up Better Than The Complainant's Testimony From The Day Before & Is Able To Answer The Question's Put To Him With Some " Conviction "  Not Sure If The C.P.S. Is Finished With Him Yet Or If It Will Continue Today Before His Own Attorney Gets To Question Him.Could Be All Done By Week's End Before It Goes To The Jury.

To Sell A Story You Need A Buyer, Unfortunately There Are Many  " Trash Rags " Who Would Buy The Story, In Saying This, The Young Lady Would Probably Have To Identify Herself To Get Credibility, Is She Willing To Do That ?  Or Will £££££ Influence Her Motive To Sell ?

John Leslie Was " Hung, Drawn & Quartered " & Went Through A Terrible Ordeal Which He Never Really Recovered From & Was Never Compensated For The " Slander " He Received.

Yes REAL Rape Victim's Have A Terrible Ordeal To Overcome The Trauma & To Be Believed In Such A Vile & Brutal Attack.

Does Ben Have Any Legal Recourse If Acquitted. The Quick Answer Is NO, Not Really The Best They Could Look At Maybe A " Civil Suit " But That Becomes Petty & What Chance Of A Judgment Being Awarded Against The Lady Would Probably Be By The Barbados Court Therefore Not Likely To Be Collectible Outside Of The Islands. Criminally, Unless The Lady Has Perjured Her Testimony Not Much Chance Of Anything Their.  I Think The Barbados Justice System Will Just " Wash There Hands" Of The Whole Thing.

Firstly, a "Not Guilty" verdict in a rape trial, doesn't necessarily do what it says on the tin!!! It doesn't necessarily mean NOT GUILTY! JUST that there is not enough evidence to convict beyond reasonable doubt!! Evidence can be missing due to a LOT of things - not to mention the victim's trauma!!!  So is John Leslie 100% not guilty????? Not convinced myself!!!! I have no sympathy!!!! Same for Mr Freeman!!!

So going on from what I've said - there is no way "action" should be taken against the girl - as not guilty doesn't mean it didn't happen!!! There ARE times when a girl/woman is PROVEN to have lied or made it up completely - and in THESE circumstances, yeah, she should be prosecuted, but NOT in just a "not guilty" verdict!!!!!

Sorry to disappoint you but I'm afraid, in this case, consensual does fit. The swimming pool that she and Ben were in was surrounded by buildings, presumably filled with other holiday guests. If she'd wanted to raise the alarm, she could have done but didn't.

There were other witnesses who testified that she was there willingly, not just Ben himself, including a security guard who saw them after the event. He testified that she did not look upset or as if she had been attacked in any way

"Disappoint me" ? On the contrary - I would hope to God that he IS not guilty - not so much for HIM, but coz I hope that the girl didn't suffer the trauma of rape!!
    HOWEVER!!.......

"If she'd wanted to raise the alarm, she could have done but didn't"

Sometimes, it is just physically IMPOSSIBLE to do ANYthing in such a situation, no matter if there were buildings about!! Some people just literally FREEZE! NO ability to shout, scream or fight (or whatever you seem to have decided she should have done!!)

    "being there willingly"

All that means is just that - that she was THERE willingly - that does NOT necessarily mean that she consented to have sex with him!!

"...she did not look upset or as if she had been attacked in any way"

NOT EVERYONE DOES!!!! Ever heard of shock? That can make people appear perfectly ok!! Not everyone who is raped LOOKS as though they've been attacked!!!

Just because this guy is a "famous"(!!) soap actor, does NOT mean he is innocent - ok, it doesn't make him automatically guilty either - but if the above is your reasons for his innocence - that's a worry!!!!!

Joanna, the unfortunate fact here is that only two people know the truth of what really happened that night and someone is lying. I'm just curious as why you automatically assume it's Ben that's lying. Whatever happened to innocent until proven guilty?

People have been known to lie about this kind of thing - they shouldn't but they do. Consequently that makes it harder for real victims to get justice for what has happened to them

Wow The Armchair Attorney's Are Out In Force

The Truth Was Told By Both Parties Involved ( The Accused & The Complainant ). Truth Is Defined By What They Felt Occurred On The Night In Question. To Have Lied Could Possibly Have Been Perjury, So To Say Either Was Lying Is A Bit Harsh. It Was The Jurist's That Chose To Believe Ben's Truth Over The Complainant's Truth. Quick Thought Here Ben,  You Were A Whisker Away From Being Charged With Statutory Rape ( By A Couple Of Months ) It Would Have Been A " Tough Sell " Getting A Not Guilty, Consent Or No Consent, Statutory Rape Is Generally An Automatic Guilty Verdict.

It Looks To Me The Only " Winner's " Here Are The Defense Attorney,s    ...  £ 200,000.00  Quite The Payday.

" Loser's "   Ben.....  Not Working,   Not Spending Christmas With The Family,  Being " Despised " By People To Quote Ben From His Interview This Morning.

" Loser's"  The Complainant ...... A Holiday Of Dreams Turned Into A Nightmare Probably ?

To All Men, Especially Celebrities, Vacation Of Dreams Can Turn Into A Vacation Of Nightmares If You Dont Keep Your Zipper Up.

I agree, the only winners are the legal teams.

Regardless of the rights and wrongs of the situation, this must be a horrible situation for anyone to be in. Now that it's all done, I hope everyone involved can put this behind them and move on with their lives
